Welcome to the final quarter of 2022, we hope that you’ve had a good October, a month of festivities and long weekends which all Malaysians have enjoyed.
The month started off with a birthday bash, as HHQ turned 22 on 1st October, we celebrated with a synchronised cake cutting ceremony across all three HHQ locations in KL, Johor Bahru and Penang.
We were honoured to have participated in the Andersen Regional Partners Meeting this year. We were welcomed by excellent hosts and wonderful Indian hospitality, even though we may have had a few more servings of the delicious vegetarian feasts than we should have. Dato’ Quek Ngee Meng also gave a talk on M&A Opportunities and Collaborations in the Region – Malaysia Perspective in one of the sessions.
Remote witness when executing a document. The first article sheds light on how executing a document can and will be different in the current high-mobility environment. The Bar Council’s guidelines come as a much needed point of reference in this post-pandemic future where virtual and remote operations have swiftly become the norm and not the exception.
It can be taxing to make follow ups and keep proper records, but it can be even more taxing when you don’t. The second article is an interesting tax case which highlights the importance of keeping proper records and documentations of your tax applications and subsequent follow-ups, in order to prevent any undue or disproportionate Customs’ decision from going unchecked.
Time savers in the dispute resolution arena. A welcomed, time saving amendment that deters delay tactics, plus a timely recognition for service by electronic means that would help save time, cost and perhaps the environment as less hardcopies of documents and notices would be necessary in light of this shift.
Enforcing Industrial Court awards. The fourth article tackles the challenge of enforcing an Industrial Court award against the defaulting party. It is a relevant article to both employers and employees when it comes to employment disputes.
