Our Partner, Ankit Sanghvi and Associate, Chew Jin Heng represented 1 of the 3 individuals who were arrested and jointly accused of shooting a businessman in Mont Kiara, Kuala Lumpur which occurred in July 2022.
All 3 individuals were jointly charged for the offence of murder under Section 302 of the Penal Code (“PC”) read together with Section 34 of the PC (punishable with death by hanging).
This matter was fixed for trial before the Kuala Lumpur High Court in July 2024.
Our criminal defence team reviewed the evidence and issued a representation letter on behalf of our client to the Attorney General’s Chambers, outlining our position and justification for the murder charge to be reconsidered.
On the first day of trial before the High Court, upon reviewing and considering the representation issued by the defence counsels on behalf of the 3 accused individuals respectively, a reduced charge of culpable homicide not amounting to murder under Section 304(b) of the PC read together with Section 34 of the PC (punishable with imprisonment of up to 10 years or with fine or with both) was offered by the Deputy Public Prosecutor.
Before the High Court, all 3 accused individuals pleaded guilty to the lesser charge of culpable homicide not amounting to murder.
Upon hearing the submissions for mitigation from the defence counsels, the High Court sentenced the 3 individuals to a term of imprisonment of 5 years from the date of the arrest.
