Our Partner, Ankit R. Sanghvi, together with Senior Associate, Chew Jin Heng and Associate, Tan Zec Kie from Halim Hong & Quek’s Dispute Resolution team, successfully acted for Bintai Gemilang Petroleum Engineering Sdn Bhd in a post-trial claim against Magnalogic Sdn Bhd before the Kuala Lumpur High Court (WA-22NCC-460-07/2023).

The dispute arose from a Service Agreement and a Supplementary Agreement, pursuant to which Bintai Gemilang paid and/or deposited sums totalling RM19,690,000.00 in relation to an oil and gas project.

Bintai Gemilang’s claim was premised on the basis that Magnalogic failed to procure the required Letter of Award, and was therefore obliged to refund the sums paid. The matter proceeded to full trial, with Magnalogic resisting the claim and raising, among others, allegations that were inconsistent with its pleaded case and the agreed facts.

On 28 April 2026, the Kuala Lumpur High Court allowed Bintai Gemilang’s claim and ordered Magnalogic to refund the full sum of RM19,690,000.00, together with interest at 5% per annum from the date of judgment until full settlement, and costs of RM80,000.

This is a significant outcome in a high-value commercial dispute, and underscores the importance of clear contractual obligations, agreed facts, and holding parties to their pleaded case.
