
Our Partner, Ankit R. Sanghvi, together with Senior Associate, Chew Jin Heng from Halim Hong & Quek’s Dispute Resolution team, successfully acted for Ahmad Zaki Sdn Bhd in defending a substantial claim arising from the East Klang Valley Expressway (EKVE) Project.
An individual commenced proceedings in the Shah Alam High Court (BA-23NCvC-62-11/2024) against several defendants, including Ahmad Zaki Sdn Bhd, alleging nuisance and/or negligence purportedly arising from the construction of the EKVE Project. The claim involved substantial reliefs, including general damages in excess of RM3 million, special damages of RM881,650, aggravated and nominal damages, interest, costs, and injunctive relief.
Acting for Ahmad Zaki Sdn Bhd, HHQ applied to strike out the individual’s claim against Ahmad Zaki Sdn Bhd. The High Court allowed the application and struck out the claim against Ahmad Zaki Sdn Bhd, with costs awarded in its favour.
The individual subsequently filed an application for leave to appeal to the Court of Appeal. On 1 April 2026, the Court of Appeal unanimously dismissed the application, with further costs of RM30,000 awarded in favour of Ahmad Zaki Sdn Bhd.
This is a significant outcome in a high-value infrastructure-related dispute, and highlights the importance of a focused and strategic defence at the preliminary stage, particularly where a claim is legally unsustainable.
